This document was prepared for the purpose of protecting personal data, information deemed sensitive or relevant and information that is provided or obtained by any person who accesses, uses or visits our website, from now on designated only by User or Customer. We reserve the right to review and amend this document without notice and such changes take effect immediately after its publication on this page. Therefore, Users should consult this document periodically.

The use of ouromar online store services always implies acceptance of the terms and conditions published on our website at the time of visit. Placing an order always implies acceptance of all the terms set forth in this document as well as other additional conditions specified in the order details.

    • 1. SCOPE OF THE CONTRACT These conditions apply to the sale of all items available in the Ouromar online store to its customers. Ouromar informs you now that the use of its online store is exclusive to those over 18 years old. The online store Ouromar is owned by the company PALAVRA SIMPLES, UNIPESSOAL LDA., registered in Portugal with the NIF 509198589.
    • 2. COLLECTION OF PERSONAL DATAThe user may be asked to share personal data, including sensitive data (such as credit card details), when making transactions on our website.
    • 3. USE OF PERSONAL DATA The personal data entrusted to us by the Users may be used for the following purposes: (a) help us prepare personalized content that meets the interests of Users; (b) to create a customer listing, with the aim of simplifying and accelerating a future order.
    • 4TH COOKIES When a user visits our website, one or more cookies are stored on their device. Cookies are used to increase the quality of the services we provide, such as to maintain your preferences, improve your experience and make it faster.
    • 5. PRICE The applicable prices are those indicated on the website at the time of order. Prices are detailed in each item and include VAT at the legal rate in force. The value of the shipping costs is indicated to the Customer at the time of the order. Ouromar reserves the right to make, at any time, the modifications it deems appropriate, and may update items and prices daily, depending on the international quotations of precious metals. The prices indicated on our page do not include customs fees and/or taxes for countries outside the European Union. Our company is based in Portugal, so all orders sent to the European Union do not have additional customs fees.
    • 6. PAYMENT All purchases can be paid by Visa, Mastercard or American Express credit card, and also through the PayPal. The choice of payment method is made during the purchase process, in the corresponding box. If you are a victim of fraudulent or improper use of your card, you must inform Ouromar immediately, by email or telephone, so that we can take appropriate action. the entities responsible for issuing and managing such means of payment. anti-fraud measures leading to the refusal of certain types of transactions. Ouromar is not responsible for the implementation of these security policies.
    • 7. PRODUCT AVAILABILITY Our page has a stock management module to prevent the sale of stock breakable items. However, if this happens, the Customer will be immediately informed and we will refund any amount you have paid.
    • 8. WARRANTY Ouromar guarantees the quality and authenticity of all its products. The items used, in the legally established terms, have a warranty of two years from the date of delivery. Defects caused by negligence, misuse or washing that does not comply with the manufacturer’s instructions are excluded from this warranty. Wear materials are also excluded from this warranty. In situations where the warranty is activated, repairs, replacement, exchange or return will be made, in the terms legally established. To activate the warranty, please contact our customer service via email geral@ouromar.pt. The Customer must inform Ouromar of the lack of conformity within a maximum of 2 months.
    • 9. ORDER CANCELLATION 9.1. According to Portuguese law, we must retain the articles of precious metals used for 20 working days after their purchase (art. 66, paragraph 6 of DL 98/2015). During this period, the authorities may seize the objects for various reasons in order to carry out due diligence in the context of their tasks (Art. 71(2b) of DL 98/2015). This way, until the order is shipped, we can cancel it unilaterally. If this happens, the Customer will be immediately informed and reimbursed by the same payment method used. 9.2. In the event of a computer, manual, technical, or any other origin error causing a substantial change not provided for by Ouromar in the sale price to the public, in such a way that it becomes exorbitant or manifestly derisory, the purchase order will be considered invalid and void.
    • 10. RETURN (RIGHT OF RESOLUTION) 10.1. The User, in the event of a consumer, may exercise the right of resolving without being required for any compensation, within 14 (fourteen) days from the day on which the consumer acquires physical possession of the good. To exercise this right, the User may use the draft indicated below, and must indicate all his/her identification data, the product he/she wishes to return and the date of purchase. The communication must be made, by letter, by the return of the acquired good, or by another appropriate means and susceptible to proof within the period defined above. The consumer must within 14 (fourteen) days from the date of communication of the resolution return the goods to Ouromar under the appropriate conditions of use.     • The User must request and save the document of the carrier that proves the shipment of the order. 10.2. Upon receipt of the return at Ouromar, the user will be returned the amount corresponding to the amount paid for the order (value of the sales invoice). If you have used a promotional discount code, this amount will not be refunded, i.e. the refund will only be for the amount actually paid. In the event of an Offer Card being used, a new Gift card of the same amount will be issued as the one used in the original order. 10.3. The method of refunding the amount to be returned depends on the payment method used in the respective order. In the case of credit card payments PayPal, they are credited to their accounts. In other cases, when NIB information is provided, a refund is made to the indicated bank account. Otherwise, the refund is made by check to the billing address. The refund is made up to 14 days after receipt of the free resolving will and receipt of the return of the goods. When returning your order to a Ouromar store, if the value of the product is up to 100€, the refund is made directly in the store. For amounts greater than 100€, the refund will be made by bank transfer. 10.4. In the absence of any of the components of the item sold or, if any of them is not in excellent condition, there will be no refund of the price or postage, and the product will be sent back to the initial shipping address.

12. APPLICABLE LAW AND COMPETENCE These conditions are governing portuguese law. For all matters arising from this contract, the jurisdiction of the District of MEM MARTINS is competent to the exclusion of any other.
